This privacy and cookie policy (the “Policy”) explains how „Smart Trading Software“ OOD, a limited liability company, organized and existing under the laws of Bulgaria, registered with the Commercial Registry at the Registry Agency of Republic of Bulgaria, under Unique Identification Code: 206165459, (“Smart Trading Software”, “Company” “we”, or “us”), collects, uses and discloses personal information through its website smarttradingsoftware.com (“website” or “platform”) with respect to the provision of the services on the website or when you otherwise interact with us. The Policy sets out the information that the Company must provide to you for the purpose of the EU General Data Protection Regulation (“GDPR”) which is applicable as of 25 May 2018.

You supply us with your personal information through the account application process, which we are required to retain. ⇒ Client information which we hold is to be treated by us as confidential and will not be used for any purpose other than in connection with the provision, administration and improvement of the services on the website, anti-money laundering and due diligence checks, for research and statistical purposes and for marketing purposes. Information already in the public domain, or already possessed by Smart Trading Software without a duty of confidentiality will not be regarded as confidential.
⇒ Smart Trading Software has the right to disclose client information (including recordings and documents of a confidential nature) in the following circumstances:
⟩ Where required by law or a court order by a competent court.
⟩ Where requested by regulatory authority having control or jurisdiction over Smart Trading Software or the client or their associates or in whose territory Smart Trading Software has clients.
⟩ To relevant authorities to investigate or prevent fraud, money laundering or other illegal activity.
⟩ To credit reference and fraud prevention agencies, third authentication service providers, banks and other financial institutions for credit checking, fraud prevention, anti-money laundering purposes, identification or due diligence checks of the client. To do so they may check the details the client supplied against any particulars on any database (public or otherwise) to which they have access. They may also use client details in the future to assist other companies for verification purposes. A record of the search will be retained by Smart Trading Software.
⟩ To our professional advisors provided that in each case the relevant professional shall be informed about the confidential nature of such information and commit to the confidentiality herein obligations as well.
⟩ To other service providers who create, maintain or process databases (whether electronic or not), offer record keeping services, email transmission services, messaging services or similar services which aim to assist Smart Trading Software collect, store, process and use client information or get in touch with the client or improve the provision of the services on the platform.
⟩ To other service providers for statistical purposes in order to improve Smart Trading Software’s marketing, in such a case the data will be provided in an aggregate form.
⟩ To market research call centers that provide telephone or email surveys with the purpose to improve the services of Smart Trading Software, in such a case only the contact details data will be provided.
⟩ Where necessary in order for Smart Trading Software to defend or exercise its legal rights to any court or tribunal or arbitrator or Ombudsman or governmental authority.
⟩ At the client’s request or with the client’s consent.
⟩ To successors or assignees or transferees or buyers, within ten business days prior written notice to the client.
⟩ If the client is a natural person, Smart Trading Software will use, store, process and handle personal information provided by the client in connection with the provision of the services, in accordance of the GDPR and the Bulgarian Data Protection Act and Smart Trading Software is obliged to supply the client, on request, with a copy of personal data which it holds about the client (if any).
⇒ By entering into this Agreement, the client will be consenting to the transmittal of the client’s personal data outside the European Economic Area, according to the provisions of GDPR for the reasons specified above.
⇒ Telephone conversations (if any) between the client and Smart Trading Software may be recorded and kept by Smart Trading Software and recordings will be the sole property of Smart Trading Software.
⇒ The Client accepts that the Company may, for the purpose of administering the terms of the Agreement, from time to time, make direct contact with the client by telephone, fax, email, or post.
LEGAL BASE OF THE PROCESSING OF PERSONAL DATA:
When we process your personal data we will only do so in the following situations:
⇒ Entering into and performing the services on the website: If you have an account or have registered on the website, our legal basis for processing your personal information is that it is necessary for the performance of service to you. With respect to an account, this includes facilitating access to our platform, processing payments, etc.
